General Terms and Conditions for applicants

1. General information
The Agency Wonderland Nannies, owners Justine Richardson & Clarissa Heim GbR, Gänslerweg 3a 82041 Oberhaching, accessible through the website wonderland nannies.de recruits staff such as nannies, babysitters, house keepers and tutors (hereinafter referred to as "applicants") for customers If you have a contract with Wonderland Nannies, these are the general terms and conditions of business.
They also apply to all future business relations, even if they are not again explicitly agreed. The conclusion of the contract in written form is necessary to its effectiveness. Verbal orders are only binding if they are confirmed in text form by wonderland nannies and if the applicant does not object within 3 days after receipt in text form.
2. The subject of the contract
The subject of the contract concluded between Wonderland Nannies and the applicant is exclusively to introduce, suggest and place applicants to customers of Wonderland Nannies. This service for applicants is free of charge.
3. Registration procedure/placement
To become an applicant in the Wonderland Nannies applicant pool, the applicant must first complete the Wonderland Nannies Registration form, fill it out and submit it. The form is located on the website wonderlandnannies.de.
As far as the information provided by the applicant in the application form meets the requirements of Wonderland Nannies, Wonderland Nannies will then correspond with the candidate and the candidate may then be asked to provide Wonderland Nannies with other necessary application documents e.g. (application with photo, references, certificates and police certificate request).
After examination of the documents and should they meet Wonderland Nannies agency requirements, the applicant will be asked to attend a personal face-to-face interview. It will then be decided whether the candidate is entered into the applicant pool of the Agency.
The applicant alone shall bear the responsibility for the completeness and accuracy of the documents and data. It should be considered that the applicant has no right to inclusion into the agency applicant pool.
After acceptance into the Wonderland Nannies applicant pool, Wonderland Nannies will then start searching for a potential family that the applicant could potentially work for.
The inclusion into the Wonderland Nannies candidate pool is completely free of charge.
The applicant is not entitled to transfer to a customer.
4. Information obligation of the applicant
The applicant is obliged to inform Wonderland Nannies with the terms of a successful negotiation of a job position with a customer or work contract as soon as possible - within a day. The applicant is also required to provide Wonderland Nannies with a copy of the employment contract.
The legal relationship between the parties may at any time be terminated without notice.
If the candidate wishes to withdraw from the Wonderland Nannies applicant pool, the legal relationship between the parties is considered terminated.
6. Liability of the agency
Wonderland Nannies does not accept any liability for any incurred damages to persons and property caused by the applicant. The applicant alone will only be liable for any damages.
The applicant exempts Wonderland Nannies from all third party claims for infringement of rights that third parties attain in connection with the activities of the applicant.
The applicant accepts the costs of legal defence that Wonderland Nannies would incur, should Wonderland Nannies be held accountable for infringement of rights of third parties. Wonderland Nannies advises applicants to obtain a private liability insurance (private Haftpflichtversicherung) that includes the work of babysitting.
Wonderland Nannies accepts no liability for the correctness and completeness of the information provided by the customer.
Wonderland Nannies is not responsible for the employment contract and its contents between Customers and applicants. Furthermore, Wonderland Nannies is not responsible for the obtaining of insurances (third-party liability, health or accident insurance) by the applicant.
7. Confidentiality / Data Protection
Wonderland Nannies is entitled, within the framework of cooperation with the applicant, to collect, store, process and to use the applicants’ data to the extent of which this is necessary for the placement.
Wonderland Nannies agrees that all personal information of the applicant is to be treated as confidential and not to disclose them to third parties. Wonderland Nannies is however entitled to forward data and information of the applicant to eligible customers.
The applicant agrees to the terms that any data of the customer is to be treated as confidential and not to disclose them to third parties.
The applicant has the right to obtain information and deletion of their stored data.
The law of the Federal Republic of Germany applies. The court of jurisdiction is Munich. Changes, additions and ancillary agreements are only effective if they take place in text form and have been confirmed by both parties.
